Ordinance No. 6

An ordinance for protection against danger from fire in the Village of Westerville.

PREAMBLE:  Whereas:  a number of citizens of the Village of Westerville, propose to associate together under the name of the Franklin Fire Guards for the purpose of protecting property against danger from fire:

Therefore:
Section I     -    Be it ordained by the Council of the Village of Westerville, that there shall be a fire company constituted to be known as the Franklin Fire Guards of Westerville, and such company shall be empowered to elect a Chief Director, or Captain and such other subordinate officers as may be necessary in the management of the Fire Engine, Hose, etc.

Section II     -    The persons constituting such Fire Company and the officers elected therefrom, shall be appointed by the Council, and shall be and they are hereby invested with all the powers of police officers at fires, and shall be considered as such while on duty.

Section III     -    Be it further ordained by the Council, that the said Franklin Fire Guards of Westerville, so soon as they shall be fully organized into a company of twenty-five persons, with officers, constitution and by-laws, which have been approved by the Council, shall have full power, and are hereby authorized within said corporation, at all fires, to form lines, or limits around property endangered by fire, within which no person unless he be attached to the Fire Company, or has property in danger, shall be permitted to pass and the said officers of said Fire Company shall have power to remove all persons within these limits, so that the Fire Company can perform their duties without interruption, and, if necessary, the officers of said company may direct and require all persons to assist in the labor of extinguishing the fire or protecting property.

Section IV     -    That if any person interrupt, disturb, or in any manner obstruct any member of said Fire Company in the discharge of his duties aforesaid, or shall refuse to give assistance where required by the officers, when on duty, he or they shall be reported to the Mayor, by the Chief Director of said company, and the said Mayor shall issue his warrant against the person or persons so complained against and if upon hearing he shall be satisfied that the said person or persons have violated any of the provisions of this ordinance, he shall assess a fine against each and every person so found guilty, not exceeding ten dollars and costs which shall be collected and paid over as is provided in cases of fines assessed by the corporation and for the use of said corporation.

Section V     -    It shall be the duty of the Marshal on every alarm of fire to repair forthwith to the place where such fire may happen, for the preservation of public peace.

Section VI     -    It shall be the duty of each member of the Franklin Fire Guards of Westerville, when on duty, to wear, or carry with him such badge as shall be agreed upon by said company.

Section VII     -    This ordinance to be in force from and after the organization of the Fire Company and publications.
